Terms & Conditions

These terms and conditions apply to all offers, quotes and agreements of Webdash Agency, based in Nieuwegein.

Article 1 - Definitions

• Webdash Agency: the service provider, located at Wattbaan 27, 3439 ML Nieuwegein.
• Client: the natural or legal person who enters into an agreement with Webdash Agency.
• Services: all work for which an assignment has been given, or that arises from the agreement.

Article 2 - Applicability

These conditions apply to every offer and every agreement between Webdash Agency and the client, unless the parties explicitly and in writing deviate from these conditions.

Article 3 - Offers and Quotes

All offers and quotes from Webdash Agency are without obligation, unless a deadline for acceptance is stated in the offer. An offer or quote expires if the product or service to which the offer relates is no longer available.

Article 4 - Prices and Payment

All stated prices are exclusive of VAT and other government levies, unless otherwise stated. Payment must be made via automatic debit or through the payment methods offered by Webdash Agency.

For monthly subscriptions, the amount is invoiced monthly in advance. In case of late payment, the client is automatically in default and Webdash Agency is entitled to suspend services.

Article 5 - Execution of the Agreement

Webdash Agency will carry out the agreement to the best of its knowledge and ability in accordance with the requirements of good workmanship. Webdash Agency has the right to have certain work carried out by third parties.

Article 6 - Duration and Termination

Subscriptions are entered into for an indefinite period with a minimum term of 3 months. After the minimum term, the subscription can be cancelled monthly with a notice period of 1 month.

Article 7 - Intellectual Property

All intellectual property rights to the developed or provided materials rest with Webdash Agency, unless otherwise agreed in writing. After full payment, the client obtains a right of use.

Article 8 - Liability

The liability of Webdash Agency is limited to the amount paid out by the insurance in the relevant case, or at most to the invoice amount of the relevant agreement.

Article 9 - Disputes

Only Dutch law applies to all agreements. Disputes will be submitted to the competent court in the Utrecht district.
